ZONING BOARD OF APPEALS

John & Maureen Lally                                                  Case No. SP 0612 & V0613
                                                                                                     
The Zoning Board of Appeals held a public hearing on November 30, 2006 at 7:00 p.m. in the Selectmens Room at the Starbard Building, 1204 Main Street, Holden, MA on the Application of John and Maureen Lally for property located at 271 Quinapoxet Street for a Special Permit for the expansion of a garage and the construction of a 2nd story addition above the garage and a Variance of 4.7 feet from the side yard setback requirements.

Members of the Board in attendance:  Ronald Spakauskas, Ronald Oslebo, Silvio Annunziata, Roy Fraser and Fred Lonardo.

The Chairman called the hearing to order.  Since there were no objections, reading of the legal notice and list of abutters was waived.  The secretary read the Application, Findings of Fact and one letter pertaining to the case from Pamela Harding, Town Planner/Conservation Agent and Zoning Administrator.

Mr. Lally addressed the Board and gave an overview of his case.  His family has grown over the years resulting in a need for additional space.  The Board and the applicant dis-cussed the letter from Pamela Harding.  In her opinion, a decision on the special permit expansion of a non-conforming structure could be incorporated into the decision for the variance.  

The applicant asked to withdraw his application for a special permit without prejudice.    R. Fraser made a motion to accept his request.  S. Annunziata seconded.  Vote 5-0, mo-tion approved.  Mr. Lally asked to amend his variance request and asked for a variance relief of 9.5 feet, allowing the structure to be placed 5.5 feet from the sideline.  

Since there were no further comments or questions, the public hearing was officially closed at 7:25 p.m.  The Board voted unanimously to approve the amended variance request, referencing a plan dated 9/29/06 from B&R Survey, Inc.
